This English version is a translation of the French Terms of Use (Conditions générales d'utilisation), provided for convenience. In the event of any discrepancy, the French version prevails.

1. Purpose

These terms of use (the "Terms") define the terms and conditions under which Economy Business Yield (EBY) makes available:

These Terms apply, without restriction or reservation, to any person accessing the Site and/or the Platform (the "User").

Accessing and browsing the Site implies full and complete acceptance of these Terms. Creating an Account on the Platform also implies full and complete acceptance of these Terms at the time of sign-up.

If the User does not accept these Terms in their entirety, they must refrain from any access to and use of the Site and the Platform.

Economy Business Yield reserves the right to modify these Terms at any time, under the conditions described in article 15 below.

4. Presentation and description of the Services

Economy Business Yield (EBY) is an analysis and information platform dedicated to the crypto-asset market. Its purpose is to help users turn scattered data into a more structured reading of the market, for educational and informational purposes.

The Platform offers in particular the following features, whose content and availability may change:

To provide these features, EBY relies on third-party data sources and technologies, in particular CoinGecko (market data), Cryptoast and IQ.wiki (information and knowledge bases), and artificial intelligence engines such as OpenAI and Claude (Anthropic).

When the User connects their Account to a third-party AI assistant, the analysis and answers are produced by that assistant's model, based on the data provided by EBY. Use of the assistant remains subject to its publisher's terms. These answers are Content generated by artificial intelligence within the meaning of article 8 below and do not constitute investment advice. The User can remove the access granted at any time from the Platform (Settings → Applications). The processing of data related to this connection is described in the Privacy Policy.

5. Access to the Site and creation of an Account

Access to the Site is free of charge for any User with Internet access. The connection and equipment costs needed for this access are borne exclusively by the User.

Access to all or part of the Platform's features requires the prior creation of an Account, through the page app.economy-business-yield.com/register.

To create an Account, the User undertakes to:

The User is solely responsible for the use made of their Account, except in the event of a proven fault attributable to Economy Business Yield.

6. Offers, prices and subscriptions

All or part of the Services offered on the Platform may be available free of charge or as part of a paid offer (Subscription and/or purchase of credits).

The terms of these paid offers - prices, Subscription plans, credit system, payment via Stripe, renewal, termination and right of withdrawal - are described in our Terms of Sale (Conditions générales de vente, in French), which supplement these Terms and apply to any User subscribing to a paid offer.

7. Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, a User acting as a consumer has, for any subscription to a paid offer made at a distance, a period of 14 days to exercise their right of withdrawal, without having to give reasons or pay any penalty.

However, in accordance with Article L. 221-28 of the French Consumer Code on digital content not supplied on a tangible medium, the User acknowledges that the right of withdrawal can no longer be exercised once performance of the Service has begun, with their prior express consent, and after they have expressly waived their right of withdrawal.

By subscribing to a paid offer with immediate access to the Services, the User expressly agrees that performance begins immediately and consequently, and to that extent, waives their right of withdrawal.

8. No advice and risk warning

The Content available on the Site and the Platform (data, comparisons, diagnoses and analyses, including those generated by artificial intelligence) is provided for purely informational and educational purposes.

It does not in any way constitute investment advice, financial, tax or legal advice, or a personalized recommendation within the meaning of the applicable regulations, in particular Regulation (EU) 2023/1114 on markets in crypto-assets ("MiCA"). Economy Business Yield is not a crypto-asset service provider within the meaning of that regulation and is not authorized to provide advice on crypto-assets, to manage portfolios, or to execute orders on behalf of third parties.

The data displayed (prices, indicators, rankings) comes from third-party sources and is provided "as is": it may contain errors, update delays or inaccuracies and is not guaranteed to be accurate, complete or available in real time.

In accordance with Article 50 of Regulation (EU) 2024/1689 on artificial intelligence (the "AI Act"), any Content generated or substantially modified by an artificial intelligence system, in particular the AI Diagnosis, is presented as such on the Platform. This Content may nevertheless contain errors, approximations or omissions inherent in this type of technology.

Crypto-assets carry a high risk of partial or total loss of capital. The User acknowledges having read our Risk warning (in French) and remains solely responsible for their decisions.

9. User obligations

When using the Site and the Platform, the User undertakes to:

Failure to comply with any of these obligations may result in the suspension or deletion of the User's Account, without prejudice to any action for compensation for damage suffered by Economy Business Yield or by third parties.

10. Intellectual property

All elements of the Site and the Platform (texts, logos, graphics, interfaces, databases, algorithms, source code) are protected by intellectual property rights and remain the exclusive property of Economy Business Yield or its partners and suppliers, in accordance with our Legal notice (in French).

No provision of these Terms may be interpreted as granting the User any right or license to the Content of the Site and the Platform other than a personal, non-commercial right of use, within the normal use of the Services.

The analyses and diagnoses generated by the AI Diagnosis from the User's data or requests may be consulted and used by the User for their personal use. They remain based on technologies, models and databases belonging to Economy Business Yield or its partners, in particular its artificial intelligence model providers.

11. Availability, maintenance and changes to the Services

Economy Business Yield uses reasonable means to ensure continuous access to the Site and the Platform, without however being bound by an obligation of result.

Access to the Site and/or the Platform may be interrupted, suspended or limited, in particular for maintenance or update operations, or due to circumstances beyond Economy Business Yield's control (failure, default of a third-party provider or data or artificial intelligence supplier, force majeure).

Economy Business Yield reserves the right to change, modify, suspend or remove all or part of the features of the Site and the Platform at any time, without giving rise to any compensation for the User, subject, for Users with an ongoing paid subscription, to the applicable legal provisions.

12. Liability

Economy Business Yield strives to provide reliable and up-to-date Services, without being able to guarantee the absence of errors, interruptions or inaccuracies.

To the extent permitted by law, Economy Business Yield cannot be held liable for:

No provision of these Terms is intended to exclude or limit Economy Business Yield's liability in cases where French law prohibits it, in particular in the event of gross negligence, fraud, or breach of the security of personal data.

13. Personal data and cookies

The processing of Users' personal data, and the use of cookies and trackers on the Site and the Platform, are described in our Privacy and Cookie Policy.

14. Term, suspension and termination

These Terms apply for the entire period during which the User uses the Site and/or the Platform.

The User may stop using the Site and the Platform at any time and request the deletion of their Account and data, under the conditions described in our Privacy Policy.

Economy Business Yield reserves the right to suspend or terminate, automatically and without notice, a User's access to their Account and/or the Platform in the event of a serious or repeated breach of these Terms, without prejudice to any damages Economy Business Yield may claim.

15. Changes to the Terms

Economy Business Yield reserves the right to modify these Terms at any time, in particular to adapt them to changes in the Site, the Platform, or the applicable regulations.

The applicable Terms are those in force on the date the User accesses the Site or the Platform. In the event of a substantial change, Economy Business Yield will endeavor to inform Users with an Account by any appropriate means, in particular by email or by notification on the Platform.

Continued use of the Site or the Platform after the amended Terms come into force constitutes acceptance of them.

16. Governing law and dispute resolution

These Terms are governed by French law.

In the event of a dispute, the User is invited to first contact Economy Business Yield in order to seek an amicable solution, using the contact details given in article 17 below.

In accordance with Articles L. 616-1 and R. 616-1 of the French Consumer Code, and failing an amicable resolution, any User acting as a consumer may refer the matter free of charge to the following consumer mediator: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice)

Failing an amicable or mediated resolution, and subject to the mandatory jurisdiction rules applicable to consumers, the competent French courts shall have sole jurisdiction over any dispute relating to the validity, interpretation or performance of these Terms.
